I Was Hit By An Uninsured Driver. Now What?

In Texas, drivers are required to carry auto insurance each time they get behind the wheel of a car. At a minimum, Texas law requires every driver to have auto liability insurance if not full auto coverage. Unfortunately, not every driver obeys state law. What happens when you are involved in a collision with an uninsured driver? Typically, the car accident will require the use of personal injury lawyers to ensure that you receive a fair settlement.

Make a Call to the Police
If you are sitting at a red light in and around Houston and an uninsured driver suddenly collides with your vehicle, your first thought might not be to contact police. Although it’s prudent to contact police following an accident, few drivers do. You may be in a hurry and the damage might not seem that severe when you get out to inspect your vehicle. You may be in a rush to get to reach many attractions in the area. But contacting police will lay the foundation for a much smoother claims process. It will also allow you to have grounds for deciding who is at fault.

Take Pictures
Although you may have to put off your heavily anticipated night of musical fun in Austin or cancel a walk along the river in San Antonio, it’s important to take many photos of the damage. While a police report can help establish fault, the report may not have a comprehensive listing of the damage caused by the uninsured motorist. Taking pictures of the damage leaves little doubt as to the extent of damage to all vehicle and/or property involved.

Contact Your Insurance Company
Your next step should be to file an uninsured motorist claim through your auto insurance company. This will assist with medical bills and repairs to your vehicle. The claim should be filed promptly, as most insurance companies offer 30 days to file an uninsured motorist claim.

Keep All Receipts
When receiving medical care for injuries resulting from an auto accident, keep all documentation and receipts. If your vehicle undergoes repairs, be sure to retain receipts as well. You will want to keep said receipts in case your insurance provider rejects your claim for whatever reason.

Contact an Attorney
