Allstate Driving Up Litigation Costs?

Could you imagine an insurance company actually doing the right thing after you’ve been involved in an accident with one of their insured? Well if you answered no to this question it’s because at some point and time in your life you have had to deal with an insurance company and know firsthand how difficult it can be to get not only the compensation, but the treatment and customer service that you deserve.

Well it turns out that these big bad insurance companies have a formidable foe, known as Personal Injury Lawyers which is usually the best weapon in your arsenal to fight against these multi-million dollar insurance companies.

I mean let’s face it if Insurance companies lived up to what the claimed to be then there wouldn’t be a need to Personal Injury Attorneys.

Now it seems like a major insurance company known as Allstate Fire and Casualty Insurance Co. is having class action suit formed against them for putting up unqualified expert witnesses to drive up litigation costs.

What this pretty much boils down to is making it difficult for lawyers to litigate cases against Allstate. Which ultimately affects those that were involved in accidents from getting the settlements that they deserve, as the difficulty deters plaintiff firms from filing suit for their clients and recover medical expenses they’ve incurred and how much they’ve already paid.

Per LAW.COM “The litigation alleged Allstate has been retaining the witnesses “in an effort to improperly harass and defraud plaintiffs and all other members of the class.” When Allstate uses one of the three witnesses, it forces a plaintiffs attorney to incur time and expenses to file motions to strike them. When that fails, plaintiffs lawyers must do depositions of their own experts or bring them to trial so they can counter the improper affidavits.” This causes a lot of time and effort to be wasted.
